Please read these terms carefully before using Pomidor.
Pomidor is an informational tool for personal record-keeping only. The milestone information, developmental guides, age ranges, and any other content within this app are provided for general informational and educational purposes only.
Nothing in this app constitutes medical advice, diagnosis, or treatment. The content is not a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider. Developmental milestones are generalised reference ranges and every child develops at their own pace. The information in this app does not account for your child's individual health history, premature birth, medical conditions, or other personal circumstances.
1. Acceptance of Terms
By downloading, installing, or using Pomidor, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app.
2. Informational Purpose Only
Pomidor is a personal tracking and reference tool. Milestone data and developmental guides are drawn from publicly available research and guidelines and are intended solely to help parents and caregivers keep informal records and learn about general developmental patterns. They are not tailored to any individual child's circumstances.
3. No Warranties
Pomidor is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be error-free, uninterrupted, or that any information within it is complete, accurate, or current.
4. Limitation of Liability
To the fullest extent permitted by applicable law, the developer of Pomidor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or in connection with your use of or inability to use the app — including but not limited to reliance on any milestone, guide, or developmental content within the app — even if advised of the possibility of such damages.
5. User Responsibility
You are solely responsible for all decisions you make based on information provided by this app. We strongly encourage you to consult qualified healthcare professionals regarding your child's development and health. The app is a supplement to — not a replacement for — professional medical care.
6. Indemnification
You agree to indemnify, defend, and hold harmless the developer of Pomidor from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the app, your reliance on any milestone, guide, or developmental content within the app, your violation of these terms, or your infringement of any rights of a third party.
7. Data and Privacy
Your use of the app is also governed by our Privacy Policy, which is incorporated into these terms by reference.
8. Intellectual Property
All content, design, code, and data within Pomidor are the property of the developer and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.
9. Modifications
We reserve the right to modify these terms at any time. Material changes will be communicated through an in-app notice. Continued use of the app after changes constitutes acceptance of the revised terms.
10. Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of the Russian Federation, without regard to its conflict-of-law principles. Any disputes arising from these terms or your use of the app shall be resolved exclusively in the competent courts located in the Russian Federation, and you consent to the personal jurisdiction of those courts.
11. Severability
If any provision of these terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect.
12. Entire Agreement
These terms, together with the Privacy Policy, constitute the entire agreement between you and the developer regarding the use of Pomidor and supersede any prior or contemporaneous understandings, communications, statements, or representations — whether oral or written — relating to the app. No representation, promise, or inducement not contained in these terms shall be binding.
